Intellectual Property & Use of Artworks

This policy explains the rights that NTE 11.22, S.L. (trading as HEIART Gallery), with tax ID B93788248 and registered address at C/ Felipe Sánchez de la Cuesta y Alarcón 2, 29005 Málaga, Spain, holds over the artworks, images and content available on heiartgallery.com and in our gallery in Málaga. It forms part of our Terms of Service.

1. Ownership of the artworks and content

All artworks, images, designs, product photographs, mock-ups, texts, logos and other creative materials on our website or in our gallery are protected by Spanish intellectual property law (Royal Legislative Decree 1/1996, Spanish Intellectual Property Act), European Union law and international copyright treaties.

The intellectual property rights belong to HEIART Gallery and/or to the respective artist. Buying a product does not transfer any of these rights.

2. What you receive when you buy an artwork

When you buy an artwork from us, you become the owner of that physical piece. You may:

  • Display it in your home, office or studio.
  • Display it in business premises such as hotels, restaurants, shops or offices, as part of the decoration of the space.
  • Give it as a gift.
  • Resell that single physical piece you bought, as permitted by law, provided you do not use our product images or descriptions or suggest any link with HEIART Gallery.

3. What is not permitted without our written consent

  • Reproducing, copying, scanning, photographing for reproduction or reprinting any artwork, including ordering prints from other printing services.
  • Creating digital versions, modified or derivative works, NFTs or AI-generated works based on our artworks.
  • Making products or merchandise that include our artworks or images.
  • Using our artworks, images or product photographs in advertising, branding, catalogues, websites, social media or marketplaces.
  • Selling our artworks as stock in a shop, gallery or online store, or distributing them wholesale.

4. Businesses, interior designers and professional projects

We work with hotels, restaurants, interior designers and other businesses. If you would like to use our artworks in a commercial project, buy several pieces for resale, or use images of the artworks in your own communications, please contact us and we will agree the terms in writing.

5. Brand

The name HEIART Gallery, its logo and visual identity may not be used or imitated, nor used to suggest partnership, endorsement or affiliation without our written permission.

6. Reporting unauthorised use

If you see our artworks or images being used without permission, or if you believe any content on our website infringes your rights, please write to info@heiartgallery.com with the relevant links and details. We will review every report.

7. Enforcement

We may take the legal action available under Spanish and European law against any unauthorised use of our artworks or brand, including requesting the removal of content from websites and platforms and claiming compensation for damages.

8. Changes to this policy

We may update this policy to reflect changes in the law or in how we work. The current version will always be available on this page.
